The anti-doping policies of the World Anti-Doping Agency (WADA) aim to promote a level playing field and protect the health of the athlete. Anti-doping policy discourages research using performance enhancing drugs (PEDs) or methods and prohibits athlete support personnel, including healthcare providers, from providing advice, assistance, or aid to an athlete or others seeking to use, or using PEDs until harm has occurred. Athletes are individually responsible for the presence of a prohibited substance in their bodies and face sanction regardless (...) of knowledge or intent. I will argue (i) that WADA policies fail to meet the epistemic and control conditions needed to adequately assign individual responsibility and (ii) that transferring responsibility for use of PEDs solely to the athlete results in harm. WADA is drifting perilously close to the morally impermissible ‘doing of harm’ to athletes by initiating or sustaining a causal sequence of events that can result in harm. (shrink)

In this book the practical dimension of social justice is explained using the analysis and discussion of a variety of well-known topics. These include: the relation between theory and practice in normative political philosophy; the issue of justice under uncertainty; the question of whether we can and should unmask social injustices by means of conspiracy theories; the issues of privacy and the right to privacy; the issue of how certain psychological states may affect our moral obligations, in particular the obligation (...) to treat others fairly; and finally the concepts of morality, fairness, and self-deception. The primary goal of the book is to provide readers with an updated discussion of some important and practical social justice issues. These issues are presented from a new perspective, based on the author ́s research. It is hoped that bringing these topics together in a single book will promote the emergence of new insights and challenges for future research. At first sight constitutionalism appears to be a key concept in public law discourse in the United Kingdom. It appears in all the major academic discussions from the rule of law and judicial review to the ‘new constitutional settlement’ and in relation to constitutional culture. And yet attempts to define the scope, meaning and role of constitutionalism remain vague. This article discusses the different fields in which constitutionalism is discussed and the different meanings that are attributed to the concept. It (...) shows that constitutionalism is routinely conflated by public law scholars with other constitutional values and principles, like the rule of law or separation of powers. This article argues that constitutionalism should either be conceived as distinct from those concepts or, failing that, can safely be eliminated from public law discourse. The article concludes by asking whether a nuanced and normative discussion of constitutionalism could have any meaningful application in the United Kingdom constitution. (shrink)

El proceso de Ibn al-Japó ha pasado a la historia debido a la personalidad del incul-pado. La mayoría de las opiniones coinciden en declarar la acusación y el proceso como un simulacro para conseguir su muerte, pues la acusación de alta traición, por las cir-cunstancias que incidieron en el caso, no iba a conseguir el objetivo propuesto. Por esta razón se buscaron otros motivos con que inculparle y que permitieran perseguirlo y con-denarlo en cualquier parte del Islam, por eso estas (...) acusaciones sólo podían responder a delitos de lesa religión. Y se encontraron. Las acusaciones que se analizan en este traba-jo figuran en varios textos, en al-Marqaba al-`ulya y en las obras de al-Maqqari, algunos de ellos no traducidos hasta ahora. En el desarrollo de las actuaciones se observan irregu-laridades procesales, pero tanto en Granada como en Fez, la condena se centra en la figu-ra del zindiq cuya sentencia final fue la pena de muerte. ABSTRACT The trial of Ibn al-Khatib has left its mark on history because of the personality of the accused. Most scholars in the past Nave thought that his accusation and subsequent trial on religious grounds were no more than excuses intended to bring about his death, as a trial for high treason would, for various reasons, not have been possible. For this he had to be accused of crimes against religion as this was the only sure way of mounting a successful case against him. The accusations analysed here are taken from a variety of sources including Al-Marqaba al- `ulyá and the works of al-Maqqari, some of which have not been translated before. We notice procedural irregularities in the course of the trial, but both in Granada and in Fez the focus is on the zinddq who is 6nally condemned to death. (shrink)

Readers may assess for themselves the importance and influence of her ideas on "women’s" issues such as marriage and divorce, education, domestic violence, and suffrage. And they will note the overlap of her ideas on ethics, religion, arts, and socialism, written in the 1830s, with her more famous husband’s works, published 25 years later.

On Liberty celebrates a collaborative theory of knowing exemplified in the way Harriet and John worked together. They believed fervently in the power of individuals struggling together to grasp the truth – including both the “idealistic” belief that there is truth as opposed to mere subjective opinion, and a deep scepticism about the beliefs accepted by the majority.

The relation between the constitutionally founded supremacy of the parliament and the authoriy of the Prime Minister based on common law, is of a great importance in the Low Countries. This relation constitutes the difference between parliamentary and presidential regimes. It is the PM's duty to take care of the permanent support ofthe parliamentary majority. This is not an easy exercise. Members of parliament are not always as positive about the PM's parliamentary performances. Characteristics of the parliamentary activity of the (...) Belgian PM's Wilfried Martens, Jean-Luc Dehaene and the Dutch Ruud Lubbers are handled as: the frequency and the extent of the PM's parliamentary performances, the topics handled by the PM's in parliament, the PM's opponents in parliamentary debate and finally more generally the PM's parliamentary role behaviour. Due to the different position of both the parliament and the PM in the Belgian and the Dutch political system, the characteristics of the parliamenty activity of the Belgian and the Dutch PM are not always very similar. At the Belgian parliamentary elections in June 1999, the Flemish nationalist party 'Volksunie' which formed an alliance with the social-liberal ID21 progressed slightly. On July 10, 1999, the party decided to participate in the purple-green-yellow Flemish government, but at the same time they decided to stay out of the federal Belgian government. Two years later, the VU-Party Bureau decided that due to deep divisions within the party it had become impossible for the party to continue. The 15.000 party members were (...) asked to judge about the future of the party. Because no party project managed to obtain a 50 %-majority in the party member referendum, the VU dissappeared. Two new parties - the 'Nieuw-Vlaamse Alliantie' and 'Spirit' - emerged from the ruins of the VU. The collapse of the VU can be seen as the most far-reaching change in the Flemish party political context of the last decade. This article focusses on the last two and a half years of the VU and on the first year of the N-VA and Spirit. In a first part, achronological overview is build up. This part provides an overview «from day to day» of the events that played a role in the collapse of the VU and the creation of the N-VA and Spirit. The second part of the article draws amore morphological picture of the VU, the N-VA and Spirit: data are presented about the internal organisation of these parties. By offering an extensive overview of facts and figures, it is the intention of the authors to provide a solid guidelinefor further investigation. (shrink)
